Obtaining a home mortgage modification in Florida

Many people in the Miami-Dade area struggle with house payments they cannot afford. While the federal government offers the Making Home Affordable Program to allow homeowners reduce their mortgage payments by obtaining a modification, banks often drag out the process. One tactic is to ask homeowners to resend the same documents over and over.

Homeowners who hire attorneys are more successful in obtaining mortgage modifications than those who don't. Here are some examples of what a lawyer can do for you:

  • Get you into the right program. The Making Home Affordable program includes a variety of options to Florida residents, including the Home Affordable Modification Program (HAMP), the Home Affordable Refinance Program (HARP), the Home Affordable Foreclosure Alternatives program (HAFA), the Home Affordable Unemployment Program (UP) and the Hardest Hit Fund (HHF). An attorney can help you review your options and get you into the most appropriate program.
  • Represent you in negotiations with the bank. A bank is less likely to ask you to send the same documents over and over if an attorney keeps records of what information you sent to the bank and how you sent it.

Evaluate bankruptcy as an option. Bankruptcy includes an automatic stay that will stop a mortgage company from foreclosing on your house. This can help give you the time you need obtain a modification. Filing bankruptcy also allows you to submit your mortgage modifications documents electronically.
